1. Introduction and Acceptance of Terms

Welcome to Dmation World ("Platform", "we", "us", or "our"). Dmation World is an online marketplace that enables users to buy, sell, and access digital models, 3D assets, and digital designs. These Terms of Use ("Terms") govern your access to and use of our Platform, including all features, content, and services offered through www.dmationworld.com.

By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.

We reserve the right to modify these Terms at any time. Continued use of the Platform following any changes constitutes acceptance of the revised Terms.

2. Eligibility

To access or use Dmation World, you must:

Be at least 18 years of age, or the age of majority in your jurisdiction, whichever is greater.
Have the legal capacity to enter into a binding agreement.
Not be prohibited from using the Platform under any applicable law.

By using the Platform, you represent and warrant that you meet all eligibility requirements stated above. Dmation World reserves the right to suspend or terminate accounts that do not comply with these requirements.

3. User Accounts and Registration

To make purchases or list assets on Dmation World, you must register for an account. You agree to:

Provide accurate, current, and complete information during registration.
Maintain and promptly update your account information.
Keep your login credentials confidential and not share them with third parties.
Notify us immediately of any unauthorized access or breach of your account at info@dmationworld.com.
Accept responsibility for all activities that occur under your account.

Dmation World reserves the right to suspend, deactivate, or permanently delete accounts that violate these Terms or are found to be fraudulent, inactive, or harmful to the Platform.

4. Licensing and Usage Rights

4.1 Permitted Use

Upon completing a purchase, Dmation World grants you a non-exclusive, non-transferable, limited license to use the purchased digital asset strictly as follows:

For commercial projects, whether by individuals or companies, including use in client deliverables, commercial productions, and promotional materials.
For educational and personal learning purposes.

All rights not expressly granted herein are reserved by the original creator or Dmation World, as applicable.

4.2 Restrictions

You expressly agree that you will NOT:

Resell, sub-license, redistribute, or transfer any asset obtained through Dmation World to any third party.
Use any asset for purposes that violate applicable laws, regulations, or third-party rights.
Modify and redistribute an asset in a manner that disguises its original source.
Use assets in any way that could compete with or harm Dmation World or the original creator.

4.3 Enforcement

If unauthorized distribution, resale, or sub-licensing of any Dmation World product or asset is identified, Dmation World reserves the right to take all appropriate legal action, including but not limited to injunctive relief, damages, and termination of your account without notice.

5. Payment and Delivery

5.1 Payment

All prices displayed on the Platform are in the applicable listed currency and are inclusive of applicable taxes unless stated otherwise. By completing a purchase, you authorize Dmation World or its payment processors to charge your selected payment method.

Payments are processed via secure third-party payment gateways.
Dmation World does not store your full payment card details on its servers.
All transactions are subject to verification and fraud prevention checks.

5.2 Automated Delivery

Upon successful completion of payment, the purchased digital asset will be automatically dispatched to the email address provided during the checkout process. It is your sole responsibility to provide a valid, accurate, and accessible email address.

5.3 Customer Responsibility and Inaccurate Information

Dmation World is not liable for failed, delayed, or incomplete deliveries resulting from incorrect, incomplete, or invalid contact details provided by the buyer. In such cases:

Payments are non-refundable.
Assets may not be resent or recovered without Dmation World's sole discretion.
Dmation World may attempt to assist on a best-effort basis but provides no guarantee of resolution.

6. Refund and Return Policy

6.1 All Sales Are Final

Due to the digital and downloadable nature of the products available on Dmation World, all sales are final. Once a purchase is completed and the asset has been delivered, no returns, exchanges, or refunds will be issued under any ordinary circumstances.

6.2 Technical Exceptions

A refund may only be considered in the event of a verified technical defect originating from Dmation World's own systems that prevents the functional use of the purchased asset. To submit a refund request under this exception:

Contact us at info@dmationworld.com within 7 days of purchase.
Provide your order ID, a description of the technical issue, and any supporting screenshots or logs.
Dmation World will investigate the issue and, at its sole discretion, issue a refund or replacement asset if the defect is confirmed.

Refunds will not be considered for reasons including but not limited to: change of mind, incompatibility with third-party software not disclosed by Dmation World, or user error.

7. Seller Obligations (For Asset Creators)

7.1 General Seller Responsibilities

If you list and sell digital assets on Dmation World, you agree to the following obligations:

You own or have full rights to list, sell, and license the asset on this Platform.
Your assets do not infringe upon any third-party intellectual property, trademark, or copyright.
You will provide accurate descriptions, previews, and specifications for all listed assets.
You grant Dmation World a non-exclusive license to display, promote, and distribute your assets on the Platform.
Dmation World may remove any listing at its sole discretion if it is found to violate these Terms or applicable laws.

7.2 Commission Structure

Dmation World charges a platform commission on all sales made through the Platform. By listing an asset for sale, you acknowledge and agree to the following:

A commission of 20% (inclusive of applicable taxes) is applied to every completed sale on the Platform.
This commission is automatically deducted at the time of the transaction, no separate invoice or billing is required.
The remaining 80% of the sale price constitutes your net payout. For example, if your asset is sold for ₹100 (or $100), Dmation World will deduct ₹20 (or $20) as commission, and you will receive ₹80 (or $80).
Payouts will be processed in accordance with Dmation World's payment schedule, which will be communicated separately or made available in your seller dashboard.
Dmation World reserves the right to revise the commission rate with reasonable prior notice to sellers. Continued listing of assets following such notice constitutes acceptance of the revised rate.

All payout amounts are calculated based on the final sale price (inclusive of any discounts applied by the seller) and are subject to applicable taxation laws in your jurisdiction. Dmation World is not responsible for any tax obligations arising on your end from payments received.

8. Intellectual Property

All content on the Dmation World Platform, including but not limited to logos, branding, website design, interface elements, and proprietary tools, is owned by or licensed to Dmation World and is protected by applicable intellectual property laws.

Individual asset listings and their intellectual property remain with their respective creators, subject to the usage rights granted to buyers upon purchase as described in Section 4.

Nothing in these Terms transfers ownership of any intellectual property from creators or Dmation World to you.

9. Prohibited Conduct

You agree not to engage in any of the following activities on or in connection with the Platform:

Uploading or distributing content that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.
Infringing any third-party intellectual property, privacy, or proprietary rights.
Attempting to reverse-engineer, decompile, or extract source data from any Platform component or purchased asset beyond permitted use.
Using automated scripts, bots, or data scraping tools to access the Platform.
Engaging in fraudulent transactions, chargebacks, or misrepresentation.
Interfering with the security, integrity, or performance of the Platform.
Impersonating any person or entity, or misrepresenting your affiliation.

10. Disclaimers and Limitation of Liability

10.1 As-Is Basis

The Platform and all assets available through it are provided on an "as-is" and "as-available" basis, without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 Limitation of Liability

To the maximum extent permitted by applicable law, Dmation World shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform or any asset purchased therein. Our total liability for any claim arising under these Terms shall not exceed the amount paid by you for the specific asset in question.

11. Third-Party Links and Services

The Platform may contain links to third-party websites, tools, or services. These links are provided for convenience only. Dmation World does not endorse, control, or take responsibility for the content, privacy practices, or terms of any third-party sites. Your interactions with third-party sites are at your own risk.

12. Termination

Dmation World reserves the right to suspend or permanently terminate your access to the Platform at any time, with or without notice, for any reason including but not limited to breach of these Terms, fraudulent activity, or conduct harmful to the Platform, its users, or creators.

Upon termination, all rights granted to you under these Terms shall immediately cease. Provisions that by their nature should survive termination (including intellectual property rights, disclaimers, and limitations of liability) shall continue to apply.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation between the parties.

If resolution cannot be reached through negotiation, the dispute shall be subject to the exclusive jurisdiction of the competent courts located in India.

14. Compliance and Entire Agreement

By completing a purchase or using the Platform, you agree to provide accurate personal details and strictly adhere to the usage limitations defined in these Terms. Please review all information carefully before finalizing any transaction to avoid loss of access or funds.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dmation World with respect to your use of the Platform and supersede all prior agreements and understandings.
